Rules and Regulations for the contestants, participating in the contest

1. The company shall display 3 (Three) questions on the website with their option to be answered by the contestant(s) participating in the contest.

2. Only those entry(ies) of the contestant(s) shall be considered eligible to win the prizes, which give / gives, correct answers for all the questions displayed during the contest.

3. To participate in the contest, the contestants shall post their entries only through the following medium : -
a). By logging on to the site: - "www.ndtvlumiere.com" and following the instructions.

4. For participation in the contest, the Contestants can follow the instructions stated on the website and participate in the contest by giving answers to the questions as per the options displayed on the contest page. Entries will be open on 26th May 2008 to 31st May, 2008.

5. All the cost(s) / expense(s) shall be borne by the contestant(s) for participation in the contest and the company shall not be liable and / or responsible for the same.

6. If the contestant(s) posts his / her entry(ies) by logging on to "www.ndtvlumiere.com", the period for posting the entries through this medium shall be as mentioned above and any entry received after the time stipulated above for every medium shall be considered invalid entry(ies) and shall be null and void.

7. The company shall not be liable and / or responsible if the entry(ies) sent by the contestant(s) does not reach the company as per the time period mentioned above.

8. Entry(ies) shall only be recognized once it / they have reached and have been acknowledged by the operator within the stipulated time period as mentioned herein above.

9. Any ambiguity to the answer to any question shall be solely decided by the company and this decision of the company shall be final and binding on the contestant(s).

10. The Company shall solely have the right to randomly select any number of winners from the eligible entries to which none the contestant(s) shall raise any objections or dispute the decision made by the Company.

11. The Company shall after selecting contestant(s) which emerge winners, send all the contestant(s) prizes which shall be decided by the Company at its sole discretion and the contestant(s) shall raise no objections to it at any time whatsoever. Any gift tax/ income tax or other applicable taxes payable on the prizes shall be solely paid by the winner(s), and the company shall not be held liable and / or responsible for the same.

II. Part B - General Rules and Regulations : -

1. The Company reserves all rights to make amendments to the existing rules without prior notice to the contestant(s). In all cases the Company shall have the sole discretion to take any decisions pertaining to the rules and regulations of the contest and such decisions of the Company shall be final and binding on all persons directly and / or indirectly connected / associated with the contest.

2. The contestants agree that he / she / they, shall hold harmless, the Company, its employees, officers or any other person in relation to any injury / damage / harm / loss suffered by him / her / them, in any manner, whatsoever in connection with the participation in the contest and shall also not file in person / through any family member and / or third party(ies) any applications, criminal and / or civil proceedings in any courts or forum in India against the Company to claim any losses, damages or relief's etc.

3. The Company is in no manner whatsoever responsible and / or shall not be held liable in any manner whatsoever, for any injury, death, mental trauma caused to the contestant(s) in any manner whatsoever for reasons including but not limited to, the results of the contest.

4. Employees of the Company, and the members of their immediate family, persons with criminal convictions, are not eligible to participate in the contest.

5. The participation of the contestant(s) in the contest shall mean that the contestant(s) have read, understood, accepted and agree(s) to abide with all the rules and regulations comprising the specific rules and regulations and the general rules and regulations of the contest.

6. All and any incidental costs direct and/or indirect including but not limited to any/ all taxes, in relation to the Prize, shall be borne by the winner(s) and in no manner whatsoever shall the Company, be responsible for the same.

7. The contestant(s) and or the winner(s) shall at all times be liable to sign and submit to Company any declarations and/or documents as required to be executed by Company with reference to the Contest. Non-acceptance by any contestant(s) and/or the winner(s) of the declarations and/or documents stated herein will disqualify them from participation or winning, immediately, as the case may be.

8. Non-conformance by any contestant(s) and/or the winner(s) of the rules and regulations of the Contest will disqualify them from participation or winning, immediately, as the case may be.

9. The contestant(s) cannot exchange the Prize for cash equivalent. If the winner refuses to accept the Prize offered, the Company shall be released from all obligations towards the winner in connection to the Prize won by the winner(s). Further, after forfeiting the Prize, the company shall at its own discretion be entitled to randomly select and declare another winner(s) from the eligible entries, as it deems fit, and award the Prize, to that winner(s) to which the disqualified winner shall have no claim or objections of any nature whatsoever.

10. The prizes shall be sent to the winners through courier. The winner(s) agrees that he/she shall not hold the company and/or its employees, responsible for delays in delivery due to shortage of stocks from the suppliers of the Prize. The winner(s) further agrees that he/she shall not hold responsible the company, if in the event, the winner(s) fails to take possession of the Prize for reasons whatsoever. In such an event, the winner(s) right to the Prize shall be forfeited. Further, after forfeiting the Prize(s), the company shall be entitled at its own discretion to randomly select and declare another winner from the eligible entries, as it deems fit, and award the Prize, to that winner(s) to which the disqualified winner shall have no claim or objections of any nature whatsoever.

11. Neither the company nor its employees have given a guarantee regarding the quality of the Prize and the winner(s) further agree not to hold, the company and/or its employees, responsible with regards thereof. It is clarified that the company shall not be responsible for the brand, quality, value etc. in connection to the Prize.

12. If due to any reason, whatsoever, beyond the control of the company, the Prize and/or the enjoyment of the Prize becomes ineffective or invalid, the company shall not be responsible for the same.

13. The participation of the contestant(s) in the Contest shall mean that the contestant(s) has read, understood, accepted and agrees to abide with all the rules and regulations of the Contest.

14. The terms of this rules and regulations shall be construed in accordance with the laws of India and incase of any dispute or other matter arising in reference to the Contest shall be referred to a sole arbitrator appointed by the Company and shall be governed by the Arbitration and Conciliation Act, 1996, amended from time to time. The venue for arbitration shall be New Delhi, in English language. The costs, charges and expenses in connection to arbitration shall be solely borne by the participant(s) / contestant(s) disputing.
